These Terms of Use govern your access to and use of this website and, where applicable, the information and materials it contains. They do not by themselves create any client relationship or entitle you to any product or service.
Any product or service provided by a member of the Lydiam Group is governed by a separate written agreement with the relevant Lydiam entity. In the event of any conflict between these Terms of Use and that agreement, the separate agreement prevails in respect of that product or service.
1. About us
This website is operated by the Lydiam Group of companies, a collective reference to a number of affiliated legal entities operating in different jurisdictions, including Lydiam Group Ltd (England and Wales), Lydiam Group L.L.C-FZ (Meydan Free Zone, United Arab Emirates), Lydiam Group Sp. z o.o. (Poland), Lydiam Pay Corp. (Canada), and Flumen Pay LLC (United States). Each entity operates independently and in accordance with the laws and regulatory requirements applicable to it.

By accessing or using this website you agree to these Terms of Use. If you do not agree, you should not use the website. We may update these terms from time to time, and your continued use of the website constitutes acceptance of the current version.
3. No offer, advice or solicitation

3A. Reverse solicitation and own initiative
Where a client in the European Union, EEA, United Kingdom or another restricted market engages a Lydiam entity, the client confirms that the relationship with Lydiam began at the client's own initiative; that the client was not solicited, marketed to or advised by Lydiam (or any person acting for Lydiam) prior to first contact; and that the client acknowledges the relevant Lydiam entity is regulated as a money services business and is not authorised in the client's home jurisdiction, and wishes to proceed on that basis.
This clause is supporting documentation only; it does not by itself create the reverse solicitation exemption, which rests on the genuine factual position assessed per client and per service.
4. Eligibility and access
This website and our services are directed at businesses, institutions and qualifying individuals, and are not directed at any person in any jurisdiction where their publication or availability would be contrary to local law or regulation. It is your responsibility to ensure that your use of the website and any service is lawful in your jurisdiction.
5. Intellectual property
All content on this website, including text, graphics, logos, trade marks and design, is owned by or licensed to Lydiam Group and is protected by intellectual property laws. You may view and print content for your own internal, non-commercial use. You may not otherwise copy, reproduce, distribute, modify or create derivative works without our prior written consent.

These Terms of Use, and any non-contractual obligations arising out of or in connection with them, are governed by the laws applicable to the Lydiam entity that operates the website and provides the relevant service. The governing law and jurisdiction for any product or service you contract for are set out in the separate written agreement with the relevant entity. Where US clients contract with Flumen Pay LLC, the governing law and jurisdiction applicable to that relationship are set out in the relevant Flumen Pay LLC agreement.
